Labour KM Lawyers Involved in Complaint against the United States under the North American Free Trade Agreement On April 23, 2008, the Canadian Association of Labour Lawyers- Association Canadienne des Avocats du Mouvement Syndical (CALL-ACAMS), as well as numerous trade unions and labour organizations across Canada, the United States and Mexico, filed a significant Complaint against the United States under the North American Agreement for Labour Cooperation ("NAALC"), the labour side agreement to the North American Free Trade Agreement ("NAFTA"). Graham Williamson, a partner in Koskie Minsky LLP's labour department, and Susan Philpott, a partner in Koskie Minsky LLP's pension department and a former president of CALL-ACAMS, were involved in the drafting and filing of the Complaint. The complaint alleges that North Carolina and the United States are violating the international labour rights standards embodied in NAALC by denying 650,000 public employees in that state the right to engage in collective bargaining. North Carolina General Statute 95-98 prohibits state and local government employees from collective bargaining with their employer. The complainants are asking that the Canadian National Administrative Office conduct an investigation into North Carolina's alleged labour rights violations, and to issue a report and recommendations for action. These include a recommendation that North Caroline immediately cease enforcing General Statute 95-98 and move to replace it with legislation guaranteeing public sector workers the right to organize, bargain collectively, and have the right to freedom of association. Pension KM lawyers act for employees obtaining permission to appeal to the Supreme Court of Canada in major pension case A group of former employees and pensioners of Kerry (Canada) Inc., who challenged their employer's practice of paying administrative expenses and contribution holidays from their pension plan and pension fund, have been granted permission to argue their appeal to the Supreme Court of Canada. The DCA Employees' Pension Committee commenced their challenge in 2000 after Kerry converted their pension plan from a Defined Benefit (DB) Pension Plan to a Defined Contribution (DC) Pension Plan. KM's pension department last appeared in the Supreme Court in the 2004 appeal Monsanto (Canada) Inc. v. Ontario (Superintendent of Financial Services). The employees are represented by Ari Kaplan and Clio Godkewitsch, and the appeal is anticipated to be heard in Ottawa in late 2008. The name of the case is Elaine Nolan, et al. v. Kerry (Canada) Inc. et al., on appeal from (2007), 282 D.L.R. (4th) 227 (Ont. C.A.).
