Trade Union Labour and Employment Law
Introduction Koskie Minsky's Labour Law Group is one of Canada's pre-eminent Union-side legal teams. Representing trade unions and professional employees' associations in the public and private sector, our labour lawyers provide a full range of services and advice on all aspects of labour relations and employment law. Our clients include small independent and local unions as well as large Canadian and international trade unions with tens of thousands of members across North America. Although our practice is centred in Ontario, we are frequently consulted by trade unions across Canada and have appeared on their behalf before Labour Boards and Courts in other Provinces. We represent employees' interests before Labour Boards, Provincial and Federal Courts and the Supreme Court of Canada, on matters such as:
Koskie Minsky understands the importance of education for its clients and to Canada's next generation of lawyers. We conduct educational seminars and training courses for clients. We contribute our time to activities such as teaching at the University of Toronto and its Faculty of Law and are frequently involved in continuing education programmes of the Canadian Bar Association and the Law Society of Upper Canada. We are regularly called upon to speak at and prepare papers for the various other organisations providing professional educational services in our field. Various members of the group have chaired the Labour Law and Administrative Law Sections of the Ontario Bar Association. Our Alan M. Minsky, Q.C. is a former Vice-Chair of the Labour Law Specialty Committee of the Law Society's Certification Program. Our services include: Acquisition and Retention of Bargaining Rights We provide expert counsel and guidance to unions on effective organizing strategies and represent our clients in connection with provincial and federal applications for certification and in defending applications to terminate bargaining rights. The group litigates unfair labour practice complaints and applications for first contract arbitration. We are also retained in cases involving the preservation of bargaining rights through related employer and sale of business proceedings. Negotiation of Collective Agreements We are frequently called upon to assist in the process of negotiation of collective agreements and ancillary documents. In that regard, we provide tactical expertise and draft the required provisions for the collective agreement. Administration of Collective Agreements We represent clients before various administrative tribunals and private arbitrators. Our industrial union clients include members of public sector, communications, retail food, manufacturing, health care, education and federal and provincial crown corporations and agencies, and the construction industry - representing both general construction workers and skilled trades - before the Ontario Labour Relations Board and its counterparts in other jurisdictions. Employment Standards, Health and Safety, Employment Insurance, Workers' Compensation and Pay Equity We represents trade unions and their members in employment standards complaints and in employment insurance claims before Boards of Referees, the Umpire and in Federal Court. We appear regularly before the Workplace Safety and Insurance Board and the Workplace Safety and Insurance Appeals Tribunal on behalf of injured workers. We also provide counsel and representation in health and safety and pay equity matters. Summary Our labour and employment lawyers understand the unique needs of each of our clients and provide advice and representation on an ongoing basis.
