Our firm is well known across North America as a leader in the representation of trade unions, pension funds, employees and retirees in disputes pertaining to pensions and benefits. We have been involved in many of the leading Canadian cases and continue to represent our clients in contentious matters pertaining to the security of pension and benefit fund assets and the protection of our clients' interests in such cases.

Services Provided

Our services include the litigation of disputes before courts, tribunals, and arbitrators and the resolution of disputes through negotiation, mediation and alternative dispute resolution mechanisms. We also provide extensive legal opinion services to parties seeking to clarify their position or entitlements in pension and employee benefit matters. We advise pension fund administrators on difficult trust, pension and benefit law issues and bring applications to court for direction in many benefit cases. We also provide counsel in respect of taxation matters in the employee benefits field.

Our Team

Members of the firm have been involved in pension and benefit cases before all levels of courts, including the Supreme Court of Canada, the Federal Court of Appeal, the Ontario Court of Appeal and numerous trial courts, commissions and tribunals across Canada. Our firm has been very prominent in representation of clients at hearings before the Financial Services Appeal Tribunal (formerly the Pension Commission of Ontario) and continues its advocacy role before Pension Commissions and Superintendents across Canada.

Virtually, all members of our pension and benefits department are involved in advocacy at various levels. Our team has extensive experience as counsel in pension and benefit disputes and is involved in most leading pension and benefits cases in Ontario.

Koskie Minsky has an advocacy record for clients on pension and benefits matters that speaks for itself and our lawyers have appeared as counsel before all levels of court and tribunal on numerous leading decisions in this field: everything from pension surplus to pension insolvency, from class actions to advocating the rights of individuals, spouses and same-sex partners. Below are just some of the recent leading cases on which our lawyers have acted as counsel: Leading Cases
