Construction Litigation
Koskie Minsky LLP is recognized as one of the leading construction law firms in Ontario and indeed in the country. We are acknowledged by other lawyers as being leaders in this area of law and have been instrumental in the formation of both the law and legislation which governs the construction industry. We welcome the opportunity to put our knowledge and experience to work for you. The Practice We are proud of the diverse client base of our construction law practice. Our clients include lenders and owners, design professionals, general contractors and sub-trades, suppliers of services and materials, workers, unions and their benefit trust funds, and even other lawyers who are alleged to have been negligent in their representation of their construction clients. In addition to litigating and defending construction lien actions, we regularly deal with delay claims, claims related to labour and material and performance bonds, claims arising in negligence and breach of warranty and breach of trust actions, as well as tender bid claims. Our practice is not limited to the courtroom. We are committed to finding alternative methods of dispute resolution, when appropriate to the case. Members of the firm are often involved in arbitrations, mediations and negotiations and have received training to equip us to recognize where such an approach might be helpful and how to successfully participate. Our lawyers regularly attend, and are frequently called upon to teach, Continuing Legal Education seminars on numerous aspects of construction law. We also have an extremely experienced and well trained group of law clerks familiar with various aspects of construction litigation. We try to use a "team" approach to ensure that work is performed by the most appropriate person at the least expense to the client. This approach ensures that we deliver effective results and report regularly to the client who is at all times kept abreast as to the status of the case and of their financial commitment. Our Team Lexpert's Canadian Legal Directory has identified our firm's "heavyweight" construction law practice as "consistently recommended" among Toronto mid-sized and litigation specialty firms. A partner and senior member of the firm in this area is Jeffrey Long who has been practising in this field for 15 years. He was called to the Bar in 1991 and joined our firm in 1993. He is a past member of the Executive of the CBA-O Construction Law Section, a member of the Toronto Construction Association, has spoken at several construction conferences and has written numerous articles relating to construction issues. He has been involved in many high profile and complex construction law cases and is a respected and innovative litigator. Nancy Shapiro was called to the Bar in 1998 and joined us in 1999. She is the current instructor for the construction law portion of the Bar Admissions Course and the co-chair of the Continuing Legal Education committee of the Young Lawyers Division of the Ontario Bar Association. She is the co-author of 2 quarterly firm newsletters entitled 'Employment News' and 'Commercial Counsel' and a contributing author to articles which have appeared in The Litigator , Construction Links, "The Lawyers Weekly" the "Bulletin" and the Construction Law Reports. Several other members of our Litigation Department, including Law Society Bencher Larry Banack, associates Jonathan Ptak, Celeste Poltak and Doug Burns, bring their various areas of expertise to assist our construction law team. |
