Insurance Litigation
Our Insurance Litigation Group is headed by Donald H. Lapowich, Q.C. with over 35 years of experience in the Insurance Industry claims scene. Services Provided Our team has years of experience at all levels of Ontario Courts and public and professional tribunals. Our firm has developed a specialty practice in defending professional errors and omission claims. We are actively involved in coverage aspects and all types of casualty and property policies. We are familiar with insurance policies and have drafted manuscript policies in the insurance industry. We are experts on the Claims Made Policy wordings as well as general liability, casualty, property, boiler, machinery, jewellery and many more specialized forms. We are strong advocates of alternative dispute resolution methods often scheduling mediations and arbitrations with retired judges. Delivery of Services The practice of insurance litigation is varied and requires prompt attention by reason of many limitation periods and requirements to process or defend claims. Our team works together as a unit and as separate members depending on the requirements of the lawsuit. We use technology, research and data based information to carry out our duties in a proficient, cost efficient and professional manner. Group Achievements Our insurance group includes membership in the Ontario Insurance Institute where we give regular annual seminars to the industry. We are members of the Insurance Bar and lecture at the Law Society of Upper Canada and Canadian Bar Association. We have in Larry Banack a trained and experienced Arbitrator/Mediator (for automobile, property, commercial and other insurance mediation programs) who is also a Bencher of the Law Society of Upper Canada. Our members write extensively and provide monthly newsletters to the insurance industry along with seminars and programs involving current developments. Leading Cases Our insurance group has been part of a significant number of insurance cases including: professional malpractice, precedents and policy interpretation and wordings. We have supported the wording of a claims-made policy and we argued the policy validity successfully in the Ontario Court of Appeal in maintaining the insurance industry's interpretation of that type of policy. We publish articles regularly in professional magazines and insurance journals and deal in all facets of the insurance claim processes.
