Background
Koskie Minsky filed a Statement of Claim on behalf
of a proposed representative plaintiff in seeking a class action against
Whitehall-Robins Inc. Canada, carrying on business as Wyeth Consumer Healthcare
("Wyeth"). The claim alleges that Wyeth manufactured a number of cold, cough
and sinus products that contained phenylpropanolamine ("PPA").
On November 6, 2000 Health Canada issued a health advisory recommending that
consumers not use any products containing PPA because of its link to
hemorrhagic strokes and other serious medical side effects.
The claim also alleges that:
-
Wyeth failed to adequately advise consumers of the potential health risks when
taking products containing PPA;
-
consumers who purchased and ingested products with PPA were unaware that the
drug was unsafe;
-
many consumers have faced, and will continue to face, health problems
associated with the ingestion of PPA due to the inadequate warning and
inadequate withdrawal program instituted as a result of Health Canada's
Advisory of November 6, 2000; and
-
Wyeth's conduct constitutes negligence and breach of the Competition Act.
Consumers across Canada who purchased products containing PPA are seeking
damages in the amount of $100 million.
A claim was initially filed in April 2002 against both the Canadian branches of
Wyeth and the American parent company. The original claim was discontinued and
a new claim was launched against only the Canadian branch of the company in
November 2002. To view copies of the relevant court documentation filed to
