A good number of AFTER members and supporters were in attendance at Osgoode
Hall Court in Toronto on April 29th and 30th, 2002 to observe first-hand the
proceedings in the Monsanto vs. the Financial Services Commission of Ontario
(FSCO) case before the Court of Appeal for Ontario.
The three Honourable Justices (John Laskin, Stephen Goudge & Robert
Armstrong), heard arguments from the nine lawyers acting for the various
interests. A decision has not yet been rendered, and we don't expect one before
the summer recess.
AFTER, which has intervenor status in the case, was represented by
Koskie Minsky in support of FSCO (The Superintendent of Pensions).
The opposing side was as follows: Monsanto Canada Inc. (represented by: Borden
Ladner Gervais LLP), the Association of Canadian Pension Management - ACPM
(Blake Cassels & Graydon LLP) and National Trust Company, i.e. The Bank of
Nova Scotia - Scotiabank (by Osler, Hoskin & Harcourt LLP). FSCO was
represented by in-house counsel.

In reply to our formal request to the Ontario Freedom of Information Office for
details of the 156 other partial windup cases referenced at Divisional Court,
we were given a breakdown indicating the number is now 200 outstanding, even
though 24 apparently were settled, presumably via agreement between affected
employees and their employers. Click here
