Exxon Mobil Chemical Films Canada Ltd., the employer, commenced court
proceedings and issued a
Notice of Application in the Ontario Superior Court of Justice to
approve the surplus sharing proposal described to you in previous mailings,
i.e., Special Report
#2 and Member
Report #3.
On Tuesday, October 7, 2003 the Honourable Mr. Justice Winkler of the Ontario
Superior Court issued a
Court order certifying the court proceeding as a Class proceeding and
naming Messrs. John McWha and Ron Winnacott as representative respondents on
their own behalf and on behalf of all Class Members, namely, all members,
former members, past members, annuitants, spouses and other beneficiaries of
the Mobil Chemical Canada Ltd. Pension Plan for Salaried Employees of Coatings
Division.
On November 27, 2003, the Ontario Superior Court of Justice approved the

The Superintendent of Financial Services approved the proposed surplus
distribution on February 20, 2004. Please

The surplus shares were distributed to members in July 2004.
