SURESTEP CLASS ACTION


1. The law firms of Sutts, Strosberg LLP (Windsor and Toronto) and Koskie Minsky LLP (Toronto) have agreed to act together to prosecute a lawsuit against Johnson & Johnson, LifeScan Inc. and LifeScan Canada Ltd. on behalf of persons who purchased a SureStep home blood glucose monitor manufactured before August 1997 and/or the related SureStep test strips manufactured prior to March 1998.

2. The plaintiffs plead that these monitors and/or test strips were dangerously defective devices which could cause personal injury, even death. Because of the alleged defects in the monitors and test strips, their use in measuring diabetics' blood glucose levels could produce grossly inaccurate results.

3. The motion for certification of the lawsuit as a class action was heard in Toronto on April 7 and 8, 2004. Mr. Justice Cullity certified the action as a class proceeding; his reasons for decision may be reviewed here. The certification order may be reviewed here.

4. The defendants unsuccessfully sought leave to appeal the certification of the class action all the way up to the Supreme Court of Canada.

5. On May 25, 2007, Mr. Justice Cullity ordered that notice of certification of the class action be given to the Class and established an August 31, 2007 deadline by which class members, who did not wish to be part of the class, could opt out. The Notice of Certification may be reviewed here.

6. On May 25, 2007, Mr. Justice Cullity also established a litigation timetable. A copy of Justice Cullity's May 25, 2007 Order may be reviewed here.

7. On April 3, 2008, Mr. Justice Cullity amended the litigation timetable. A copy of Justice Cullity's April 3, 2008 Order may be reviewed here.

8. The parties are currently exchanging and reviewing relevant documents. Upon completion, the parties will proceed to ask questions of each other's representative under oath.

9. A similar class action brought on behalf of SureStep users in the United States settled in November 2001. The defendants in that action have agreed to pay the U.S. class members $45,000,000. The settlement does not affect Canadian class members and the class action here, therefore, will proceed.
