Plan

Koskie Minsky LLP has filed a class action against
the Bank of Canada in connection with the Bank of Canada Pension Plan. The
plaintiffs belong to the Bank of Canada Pensioners' Association and will be
requesting court certification to act on behalf of a national class. Class
members would include persons who, after January 1, 1993, were members, former
members, annuitants, spouses and other beneficiaries of the Plan.
The Statement of Claim alleges that the administrator of the Plan misused
approximately $12 Million of the assets of the pension trust since at least
1993, by using these amounts to cover expenses and costs to administer the
Plan.

On March 30, 2007, the Ontario Court of Appeal released reasons in respect of
the plaintiffs' appeal of a decision of Justice Macdonald of the Ontario
Superior Court of Justice striking portions of the statement of claim. The
Court of Appeal granted the appeal in part. To view the decision of the Ontario
Court of Appeal, please click here.
