Professional Negligence and Insurance Litigation

The Professional Negligence and Insurance Litigation Group at Koskie Minsky brings experience in leading insurance cases, professional malpractice, precedents and policy interpretation. We have successfully argued at the Ontario Court of Appeal the validity of insurance policies and interpretations, and numerous cases involving professional standards. We are lead by senior litigators, Donald H. Lapowich, Q.C. and Alfred J. Esterbauer, who bring over 40 years and 30 years of experience respectively to high value, complex insurance and liability disputes.

Our litigation practitioners represent insurers and their insureds, working at all levels of Ontario Courts, public and professional tribunals. We understand the limitation periods and requirements to process or defend claims, responding promptly, and providing expertise appropriate to the particular requirements of each case. We have a dedicated team of lawyers, ensuring cost-effective representation.

We are actively involved in coverage aspects of all types of casualty and property policies: life, disability, automobile, property, marine, transportation, environmental, fidelity, construction, directors and officers and professional errors and omissions. We have particular expertise in “claims made” policy wordings, and defending professional errors and omission claims. We are strong advocates of alternative dispute resolution methods and draw on the experience of a leading arbitrator/mediator, Larry Banack.

Our litigation practitioners contribute regularly to the insurance industry by providing seminars, articles and programs on current industry developments, and contribute to Broker Associations and insurance journals. Our Group includes membership in the Ontario Insurance Institute where we give annual seminars to the industry. We are members of the Insurance and Litigation Bar and lecture extensively for the Law Society of Upper Canada, Ontario Bar Association and other CLE providers.
