Pay Equity

Koskie Minsky has represented clients in pay equity matters in both the federal and provincial jurisdictions.

We represented one of the unions embroiled in a long and bitter pay equity case before a Canadian Human Rights Tribunal involving Bell Canada. This case, settled after almost a decade of litigation, was before every level of Federal Court, including the Supreme Court of Canada. The settlement reached was a multi-million dollar settlement affecting thousands of Bell employees.

In addition to litigating the Bell case, we have provided ongoing advice on pay equity matters to clients in the communication and airline industries.

In the provincial jurisdiction, we have represented clients before the Pay Equity Hearings Tribunal on a number of matters, including issues regarding not only the initial development of pay equity plans, including the development and implementation of gender neutral job evaluation plans, but increasingly regarding issues of the maintenance of pay equity. Maintenance issues have, with the passage of time, come to attract a great deal of attention, since many workplace parties have ignored their ongoing obligations in that regard.
