Huronia Regional Centre

Overview

This class proceeding concerns the operation of a facility responsible for the care and control of persons with intellectual disabilities.

Since 1876, Huronia Regional Centre ("Huronia") provided a residential program for mentally challenged and disabled persons. Huronia closed in March 2009. The Plaintiffs allege that members of the class were emotionally, physically, and psychologically traumatized by their experiences at Huronia.

It is alleged that the Defendant, the Province of Ontario, breached its fiduciary, statutory and common law duties to the class through the establishment, operation, and supervision of Huronia. In particular, it is alleged that the Defendant's failure to care for and protect class members resulted in loss or injury suffered by them, including psychological trauma, pain and suffering, loss of enjoyment of life, and exacerbation of existing mental disabilities.

This action was certified as a class proceeding by the Honourable Mr. Justice Cullity by reasons dated July 30, 2010. The class of persons it seeks to represent is detailed in the Statement of Claim, issued on April 21, 2009. Generally, it is comprised of all persons who resided at Huronia between 1945 and 2009, as well as certain of their family members.

Koskie Minsky LLP represents the Plaintiffs in this action.
